OBJECTIVE

To provide an update on the CCNC project per a request from City Manager Kim; seek City Council approval of Amendment No. 2 in the amount of $27,905.00 to Borders Architects for architectural consulting services; and seek City Council approval of Amendment No. 1 in the amount of $260,000.00 to Thomco Construction, Inc. for the unforeseen change orders for the construction of the Central Cities Navigation Center (CCNC) project (the “Project”).

BACKGROUND

In Fall of 2022, the City acquired the property located at 13871 West St (the “Property”) for the purposes of building a homeless shelter. The City entered into an agreement with Borders Architects for architectural consulting services related to the Project in the amount of $304,000.00. The agreement was amended in January 5, 2023, to add an additional $15,200.00 to modify the existing design scope for full cooking kitchen, for a total contract amount of $319,200. In Spring of 2023, Thomco Construction, Inc. was awarded a construction contract in the amount of $4,267,450.00 for the Project.
DISCUSSION

The Project is approximately 70% complete. The project’s key milestones include the SoCal Edison design plan and installation, mechanical, electrical, and plumbing (MEP), interior metal framing and dry wall. Additionally, the Furniture, Fixtures, and Equipment (FF&E) request for proposal (RFP) has been released. The remaining tasks until completion primarily involve finishes and furnishing. The project’s key milestones include SoCal Edison design plan and installation, mechanical, electrical, and plumbing (MEP), site work, interior metal framing and dry wall, and FF&E RFP release. The remaining tasks until completion include finishes and furnishing. In addition to providing the City Council with an update on the Project, the City Council is being requested to consider two amendments to allow for completion of the construction.

 

The original agreement with Borders Architects scoped 4 months of service. Due to a lengthy bidding process, the originally scoped hours is insufficient to get through construction completion. Therefore, Amendment No. 2 to Borders Architects will authorize additional hours beyond their original scope and includes project close-out activities covering the following tasks: construction meeting attendance, RFI support change order review and consultation, submittal review and project directives, final punch list and report, and project acceptance documentation including as-built drawings.

The original scope of work for Thomco Construction, Inc. (aka “Thomco”) did not include the installation of a security camera system as it was envisioned that this work would be done by a separate contract. Early during construction, it was determined that in order to stay on schedule, it was necessary to have Thomco sub-contract for this work. This subcontract included the purchase of products and supervision and coordination with Thomco’s electrical subcontractor to complete the work in accordance with the finalized security design plan. As a result, an unforeseen change order in the amount of $172,724.02.

 

Due to the nature of rehabilitation of an existing building, design modifications, and other unforeseen reasons, change orders need to be approved. Between the original contract amount and approved change orders, a total of $397,932.11 has been approved for payments leaving $28,812.89 in contingency remaining. There are a number of pending unforeseen changes that require additional contingency to complete the Project. Therefore, Amendment No. 1 to Thomco Construction, Inc. includes a total of $260,000.00 ($172,724.02 plus $87,275.98) in additional funding to cover the cost of the security camera system and pending change orders to complete the project.

Notably, after the approval of the aforementioned additional funding requests, the Project will remain within budget and on schedule to complete construction by June 2024.

FINANCIAL IMPACT

There is no fiscal impact on the General Fund. Funding for Amendment No. 2 to Borders Architects and Amendment No. 1 to Thomco Construction Inc. is currently included in the Central Cities Navigation Center’s construction budget, and no additional appropriation is necessary.

RECOMMENDATION

It is recommended that the City Council: 

 

  • Approve Amendment No. 2 in the amount of $27,905.00 to Borders Architects for architectural consulting services for the Central Cities Navigation Center Project (CCNC);

 

  • Approve Amendment No. 1 in the amount of $260,000.00 to Thomco Construction Inc. for unforeseen change orders for the Central Cities Navigation Center Project (CCNC);

 

  • Authorize the City Manager, or her designees, to execute Amendment No. 2 to Borders Architects, approve additional amendment terms, and make minor modifications as appropriate thereto, on behalf of the City; and

 

  • Authorize the City Manager, or her designees, to execute Amendment No. 1 to Thomco Construction Inc., approve additional amendment terms, and make minor modifications as appropriate thereto, on behalf of the City.
