Adoption of a Resolution Declaring Assessor Parcel Number 133-291-03, Garden Grove, Exempt Surplus Land. (Action Item)

OBJECTIVE

To request the City Council consider adoption of a Resolution declaring certain real property, assessor parcel number 133-291-03, Garden Grove, as exempt Surplus Land.

BACKGROUND

The City owns the approximate 870 square foot real property located at 9252 Lampson Avenue, adjacent to Leroy Avenue, Garden Grove, APN No. 133-291-03, which is the site for the abandoned Well No. 11C.  The location is shown in the attached exhibit.

 

Pursuant to the California Surplus Land Act (SLA) Section 54221(b)(1), the City Council must declare City owned real property to be “surplus land” or “exempt surplus land” prior to the City taking action to sell or dispose of real property and submit the determination to the California Department of Housing and Community Development (HCD) for its review and approval at least 30 days prior to disposition of the property.

DISCUSSION

Exempt surplus land is defined to include surplus land that is less than 5,000 square feet in area, or less than the minimum legal residential building lot size per Government Section Code 54221(f)(1)(B). Additionally, Section 103(b)(3)(B) of the Surplus Land Act Guidelines issued by HCD, local agency surplus land that is either less than 5,000 sq. ft. in area or less than the minimum legal residential building lot size for the jurisdiction in which the parcel is located, or 5,000 sq. ft. in area, whichever is less is exempt from the provisions of Articles II and III of the SLA/HCD Guidelines.

 

The subject property is an abandoned water well adjacent to an existing single-family residence.  It is 870 square feet in size, which is substantially less than the minimum legal residential building lot size and meets the requirements for the Surplus Land Act exemption.

FINANCIAL IMPACT

There is no financial impact for the City Council to adopt the resolution declaring the property exempt surplus land. An appraisal will be done on the subject property at a later time to determine the price at which it will be offered for sale to the adjacent property owner.

RECOMMENDATION

It is recommended that the City Council:

                                                                                      

  • Adopt the Resolution declaring the former Well No. 11C property exempt surplus land; and

               

  • Authorize the City Manager, or her designee, to submit the Resolution to the California Department of Housing and Community Development for their review and approval, on behalf of the City.
