OBJECTIVE

To obtain City Council approval to participate in a Cannabis Tax Fund Grant Program through the California Highway Patrol (CHP). Under the grant, the City can receive $250,000 in federal funds to implement DUI/CDL Checkpoints, selective DUI enforcement operations, and educational activities within the community.

BACKGROUND

With the passage of Proposition 64, the Control, Regulate, and Tax Adult Use of Marijuana Act (AUMA), California voters mandated the state set aside funding for the California Highway Patrol (CHP) to award grants to local governments and qualified nonprofit organizations, as described in Revenue and Taxation Code Section 34019(f)(3)(B). The Cannabis Tax Fund Grant Program marks an essential step toward reducing impaired driving crashes, increasing public awareness surrounding the dangers of impaired driving, and making California's roadways a safer place to travel. The Garden Grove Police Department has applied for and received similar grants since 1996.

DISCUSSION

The California Highway Patrol (CHP) works closely with state and local agencies and other traffic safety stakeholders to actively address impaired driving. The CHP will consider various factors in determining specific needs for each grant cycle, including opportunities and projects best suited to prevent the loss of life, injuries, and property damage caused by driving under the influence of alcohol and/or drugs.

 

The purpose of the Cannabis Tax Fund Grant Program (CTFGP) is to provide alternative funding sources to augment, but not supplant, current activities and programs. The CHP will allocate funds for the project categories by California Code of Regulations (CCR) Sections 1890.05 through 1890.07, as determined by the CHP.

FINANCIAL IMPACT

The total amount for the Fiscal Year 2023-24 grant will be $250,000. The City is not required nor plans to hire additional personnel and incur additional expenses to participate in the grant program. The California State Controller's Office appropriates the funding provided, and all grants are awarded on a competitive basis.

RECOMMENDATION

It is recommended that the City Council:

 

  • Authorize participation in the Cannabis Tax Fund Grant Program (CTFGP);
  • Accept the Office of Traffic Safety Grant Funds in the Amount of $250,000;
  • Authorize the Police Chief, Finance Director, and Finance Manager to execute the grant agreement on behalf of the City; and
  • Allocate these grant monies to fund Selective DUI Enforcement Operations.
