Adoption of a Resolution declaring the intention to vacate a street and alley for Thackery Avenue and the Alley north of Twintree Avenue, west of Harbor Boulevard.  (Action Item)

OBJECTIVE

To request that the City Council adopt a Resolution declaring its intention to vacate Thackery Avenue and Alley, north of Twintree Avenue, west of Harbor Blvd., and to set a date for a public hearing in accordance with Division 9, Part 3, Chapter 3 of the California Streets and Highways Code (§§ 8320-8325).

BACKGROUND

Thackery Avenue and Alley north of Twintree Avenue, west of Harbor Blvd. previously served as the access to single-family homes and businesses. Those homes and businesses were purchased and demolished by either the City and/or former Garden Grove Agency for Community Development (Former Agency) as part of a project to develop a hotel development. Pursuant to the development agreement, the Former Agency was obligated to fund and demolish the Alley and Thackery Avenue. The Street and Alley to be vacated is described in the attachments to the attached resolution.

DISCUSSION

Streets and Highways Code 8312 authorizes the City Council to vacate all or a portion of a street within the City pursuant to Division 9, Part 3, Chapter 3 of the California Streets and Highways Code (§§ 8320-8325). Said Chapter 3 authorizes the City Council to initiate proceedings to vacate the public street when it is no longer necessary for current or prospective public street purposes. Prior to adopting a resolution vacating the street, the City Council is required to set a public hearing and provide at least a 15-day notice of the public hearing. The attached resolution sets the public hearing date for the Council meeting on September 13, 2022. The City Clerk will publish notice of the public hearing in a newspaper of general publication in the City and the notice will be posted at three locations within the portion of the street and alley to be vacated.

 

All relevant utility companies were notified by the City, and no objections to the vacation from the utilities were received.

FINANCIAL IMPACT

Other than the cost of publication and posting of the public hearing notice, this action will not have an impact to the General Fund.

RECOMMENDATION

It is recommended that the City Council:

 

  • Adopt the Resolution declaring the City Council’s intention to vacate and abandon Thackery Avenue and Alley north of Twintree Avenue, west of Harbor Blvd., and setting a public hearing thereon.
