Award a contract to Overland, Pacific & Cutler, LLC. for relocation planning and assistance services. (Cost:  $156,500) (Action Item)

OBJECTIVE

For the City Council to approve an exemption to the bidding process and to authorize the City Manager to execute an agreement with Overland, Pacific & Cutler, LLC (OPC), for necessary relocation planning and assistance services for establishing a Navigation Center.

BACKGROUND

In September 2021, the 2021 Comprehensive Strategic Plan (CSPAH) was approved by City Council establishing the goals and strategic actions to address homelessness in Garden Grove. One of the identified strategic actions includes exploring the development of a Navigation Center.

 

The Community and Economic Development Department (Department) has been actively seeking a potential site for the advancement of a navigation center.  Given current market conditions, when a site is identified staff must act expeditiously. Acquisition of a site may have existing tenants that requires relocation planning and assistance services per the Federal Uniform Relocation and Real Property Acquisitions Policies Act of 1970, as amended (URA), California Relocation Assistance Law, Government Code Section 7260, et seq. (Law), and the Relocation Assistance Real Property Acquisition Guidelines adopted by the Department of Housing and Community Development as in Title 25, California Code of Regulations Section 6000, et seq. (Guidelines).

 

The relocation process will take at minimum five (5) months and initiating the process as soon as a site is identified is critical to the advancement of a navigation center. As such, staff is requesting an exemption to the bidding procedures for the purchase of services from OPC in excess of $25,000. OPC has staff available to begin the relocation process as soon as a navigation center site is identified. The anticipated work plan includes the development, management and implementation of a Relocation Plan and associated services for a total contact amount of $156,500. OPC is qualified by virtue of experience, proposal quality and prior record of performance with the City.

DISCUSSION

The Department is requesting an exception to the competitive bidding process on the basis of the City Manager declaring that it is in the “Best Interest of the City” and pursuant to Garden Grove Municipal Code Section 2.50.060 Item G as follows:

 

G.   When bidding procedures for the purchase of services in excess

       of $25,000 are dispensed with and the City Council determines it

       to be in the best interest of the City.

 
FINANCIAL IMPACT

No additional funding is required. Funding for the relocation planning and assistance services is included in the Low and Moderate Income Housing Asset Fund operational budget.

RECOMMENDATION

It is recommended that the City Council:

 

  • Award a contract for relocation planning and assistance services to Overland, Pacific & Cutler, LLC., for a performance period of two (2) years with the option to extend the agreement in one (1) year increments, for a total performance period of five (5) years, on an “as-needed” basis;

 

  • Authorize the City Manager, or his designees to execute the agreement and make minor modifications as appropriate thereto, on behalf of the City; and

 

  • Authorize the City Manager, or his designees, to exercise option year term extension, for available option years and sign the option year amendment.
