To request City Council approval for the acceptance of a grant “in fee” for public right of way for street and highway purposes in accordance with the requirements for approval of Street Improvement Plan A-1934 (the “Project”), for a portion of the real property located at 12202 S. Harbor Boulevard, Garden Grove, owned by Mann Enterprises, Inc. (“Owners”). |
| | | | | | | | BACKGROUND
On July 29, 2021, the Owners submitted grading/street improvement plans for construction of improvements for a 3,267 square foot Raising Cane’s drive-thru restaurant on a vacant property. The City has a policy of requiring dedications for streets “in fee” for arterial highway street right-of-way corridors where state and federal grant application requirements restrict the expenditure of these funds to public right-of-way that is owned “in fee” by the City. |
| | | | | | | | DISCUSSION
The Owners are dedicating sixty feet of right-of-way along Harbor Boulevard to the City “in fee” to maintain and meet the requirements of future grant applications for the Harbor Boulevard corridor improvements. Harbor Boulevard is designated as a major arterial. The 60-foot dedication will provide a total half-width road right-of-way of 60 feet, which is in conformance with the City’s General Plan. |

There is no impact to the General Fund. |
| | | | | | | | RECOMMENDATION
It is recommended that the City Council:
- Approve and accept the grant of public right of way “in fee” for public street and highway purposes for a portion of the property located at 12202 S Harbor Boulevard, Garden Grove; and
- Authorize the City Clerk to accept the offer of a grant of public right of way “in fee” by Street Grant Deed “in fee” on behalf of the City.
