OBJECTIVE

To request that the City Council award a contract for City Project No. 2163101280-2 - Garden Grove Park Improvements- Phase 2 to Western State Builders Inc.
BACKGROUND

The replacement of the playground equipment at Garden Grove Park is part of the capital improvement priorities outlined in the 2019 Parks and Facilities Master Plan. In November 2021, the City Council approved the request to issue a purchase order for Innovative Playground Company, Inc. for the purchase of new playground equipment at Garden Grove Park through the Sourcewell competitive bid program, Contract #010521-BUR. Following this authorization approval, staff processed the purchase order for the new playground equipment that will be installed by the selected contractor for this city project bid.  
 
DISCUSSION

Staff solicited bids for this project pursuant to Municipal Code Section 2.50.100. Eight (8) bids were received and opened by the City Clerk's office on April 11, 2022, at 11:00 a.m. Staff reviewed the bid documents submitted by the lowest qualified contractor, Western State Builders Inc., with a total bid of $263,988. This bid amount is within the current project budget. The licenses and references of the contractor have been reviewed and verified by staff, and all other documentation is in order.

 

Staff received a formal protest from the second lowest bidder, R.E. Schultz Construction, Inc., alleging that the lowest bidder, Western State Builders Inc., did not acknowledge the four addendums that were part of the bid. Staff has reviewed this formal protest and found that Western State Builders Inc. did acknowledge the four addendums in the bid proposal submitted.  The protest should therefore be rejected and the contract should be awarded to the lowest bidder.

 

The anticipated contract schedule is as follows:

 

Award Contract - April 26, 2022

Begin Pre-Construction- May 16, 2022 (estimated)

Complete Construction- July 31, 2022 (estimated) 

FINANCIAL IMPACT

There is no financial impact to the City’s General Fund. This improvement is included in the Community Services Capital Improvement Budget and is funded by Citywide Park Fee and Park Fee funds.
RECOMMENDATION

It is recommended that the City Council:

 

  • Award a contract for City Project No. 2163101280-2 Garden Grove Park Improvements- Phase 2, in the amount of $263,988, to Western State Builders Inc.; and

 

  • Authorize the City Manager to execute the agreement on behalf of the City, and make minor modifications as appropriate.
