OBJECTIVE

To request the Garden Grove Housing Authority consider a Third Amendment to the Affordable Housing Agreement with Tudor Grove, LTD.

BACKGROUND

On February 3, 1992, the former Garden Grove Agency for Community Development (Former Agency) entered into an Affordable Housing Agreement with respect to a 144-unit multifamily rental housing development known as Tudor Grove Project. The agreement was subsequently amended on September 8, 1992 (First Amendment) and on December 10, 1996 (Second Amendment).  

 

The Former Agency was dissolved as of February 1, 2012 under the provisions of Division 24, Parts 1.8 and 1.85 of the California Health and Safety Code (Dissolution Law). On January 17, 2012, the City Council designated the Garden Grove Housing Authority (GGHA) to serve and act as Housing Successor and assume the housing assets and responsibility to perform housing functions previously performed by the Former Agency under HSC 24176(b).

DISCUSSION

The Tudor Grove Project affordability period for all 144-rental units will expire on June 9, 2022, unless such date is amended.

 

GGHA’s mission is to promote adequate and affordable housing, economic opportunity, and a suitable living environment free of discrimination. As such, it is of interest to the GGHA to continue to provide suitable affordable housing to qualified Very Low Income individuals in the Tudor Grove Project beyond the current expiration date by extending the expiration date of such restrictions.

 

The Developer has successfully maintained and operated the Tudor Grove Project and complied with all monitoring requirements in accordance with the Affordable Housing Agreement, all Federal, State and local laws and housing quality standards or code requirements during the entire affordability period.  Additionally, they have demonstrated to be a reliable community partner and have expressed their desire to continue to provide affordable housing to the tenants of the Tudor Grove Project beyond the current affordability period. 

 

Therefore by this Third Amendment, the GGHA and Developer desire to amend the Affordable Housing Agreement and modify and extend the end date of the Affordability Period from June 9, 2022 until December 31, 2028.   

FINANCIAL IMPACT

None.

RECOMMENDATION

It is recommended that the Housing Authority:

 

  • Approve the Third Amendment to the Affordable Housing Agreement with Tudor Grove, LTD; and

 

  • Authorize the Director to execute the Third Amendment to the Affordable Housing Agreement on behalf of the Garden Grove Housing Authority.
