Award a contract to G4S Secure Solutions (USA) Inc., for civilian jail contract services.  (Three year contract amount:  $1,815,556.69) (Action Item)

OBJECTIVE

To seek City Council approval to enter into an agreement with G4S Secure Solutions (USA) Inc. (G4S), to provide civilian custody officer services to the Police Department.
BACKGROUND

In June 2000, the City Council approved the City’s first contract with GEO Group, Inc. (formerly C.S.I.) to provide 24-hour jail booking services for the Police Department. Using the civilian jail contract services, police officers are able to reduce the time it takes to process arrestees and return to the field to handle calls for service. On average, it takes police officers approximately two hours to handle a prisoner through the booking process. Using the jail contract services, this processing time has been reduced to 15 minutes, allowing the police officers to return to the field more quickly to handle emergency calls for service.

 

Over the past several years, there has been an increase in crime within the City and an increase in arrests made by the Police Department. In 2019, officers made 7,575 arrests for both felony and misdemeanor crimes. This is a 34.8% increase in arrests from 2014, when officers made 5,619 arrests. The time saved by having the civilian jailers process the arrestees is the equivalent of having approximately (6) additional police officers on the street.

 

In June 2019, the City Council approved a three-year agreement with The GEO Group Inc. (GEO). However, on June 25, 2020, the Police Department received notice from GEO terminating their contract with the City effective November 1, 2020. GEO advised it is terminating the contract as the result of an internal business decision to cease jail operations in the State of California.

DISCUSSION

In November 2019, the City of Westminster conducted an RFP process requesting open bids for Custody Officer Services. During that process, a request for proposal was sent to three vendors, G4S Secure Solutions (USA) Inc., Core Civic, Inc., and The GEO Group, Inc. The City of Westminster received only one proposal, from G4S Secure Solutions (USA) Inc. (G4S), who was awarded the contract by the Westminster City Council on March 11, 2020. Garden Grove City staff recommend “piggybacking” on the existing contract between G4S and the City of Westminster. 

G4S has also agreed to offer employment to the current 10 GEO employees, provided they pass an updated pre-employment screening. This will allow for a seamless transition between vendors as the GEO employees are very familiar with the current jail operations. All costs for employee training and pre-employment screening are included in the contract price and will not be billed separately.
FINANCIAL IMPACT

The proposed annual costs of the G4S contract are as follows:

 

  • FY 2020-21:         $648,284

  • FY 2021-22:         $678,888

  • FY 2022-23:         $708,608

 

The full first-year cost of the G4S contract is $648,284. However, since the contract will not go into effect until November 1, 2020, the pro-rated cost through June 30, 2021 will be approximately $432,189. The FY 2020-21 Police Department budget includes an allocation of $609,294 for the current contract with GEO. It is anticipated that the City will pay GEO approximately $197,183 for services rendered through October 31, 2020, and the remaining funds (approx. $412,111) will be reallocated to the G4S contract.

 

Fiscal year 2020-21 costs of the G4S contract not covered by the existing allocation (approx. $20,078) will be covered by public safety-restricted grant funds recently appropriated for the Police Department’s budget. The additional costs for FY 2021-22 and FY 2022-23 will paid for through a combination of grant funds, such as JAG, SLESA, Prop 172, and AB109 as they become available.  


RECOMMENDATION

It is recommended that the City Council:

 

  • Approve the agreement with G4S Secure Solutions Inc., in the amount of $1,815,556.69, for jail custody services, for the period November 1, 2020 through June 30, 2023, with an option to extend for an additional two (2) years; and

 

  • Authorize the City Manager to execute the agreement on behalf of the City, and make minor modifications as appropriate thereto.
