OBJECTIVE

For the City Council to adopt a Resolution extending for one year the expiration of discretionary land use permits that would have expired between March 1, 2020 and February 28, 2021.

BACKGROUND

The COVID-19 pandemic led to Governor Newsom's order on March 19, 2020 directing all residents in the State to stay at home.  The stay-at-home order negatively impacted most commercial and industrial sectors in the State and the City, causing a slowdown in industry and economic activity.  

DISCUSSION

Garden Grove Municipal Code section 9.32.160 provides that all discretionary land use entitlements and permits become null and void within one year from the date of approval if not exercised.  However, many residents and developers were prevented by the pandemic and stay-at-home order from exercising their land use entitlements during the pandemic.  Consequently, it would be appropriate for the City Council to extend the expiration of discretionary land use permits that would have expired between March 1, 2020 and February 28, 2021 for one year to mitigate the impacts of the pandemic on property owners and the development community.   A list of impacted discretionary entitlements is attached.

FINANCIAL IMPACT

None.
RECOMMENDATION

It is recommended that the City Council:

 

  • Adopt the attached Resolution extending for one year the expiration of discretionary land use permits that would have expired between March 1, 2020 and February 28, 2021.
