Consideration of an ordinance requiring all Commissioners to be qualified electors of the city.  (Action Item)

OBJECTIVE

To present to the City Council for first reading and introduction an ordinance amending Section 2.21.015 of the Municipal Code to require that all commissioners be and remain qualified electors of the city.

BACKGROUND

At its meeting of January 26, 2016, following its discussion pertaining to the qualifications of City Commissioners, the City Council directed the Acting City Attorney to bring back an ordinance revising the city's regulations to require that all commissioners be and remain qualified electors of the city.  The ordinance attached to this report implements this City Council directive and makes other minor non-substantive revisions to Section 2.21.015 of the Municipal Code.

DISCUSSION

Currently, Section 2.21.015 of the Municipal Code pertaining to the members of all City Commissions requires that all commissioners be and remain residents of the city and eligible to register to vote.  The regulations do not currently require all commissioners to be registered to vote in the city, except that Section 2.24.030 requires that the members of the Planning Commission be qualified electors of the city.

 

At its meeting of January 26, 2016, the City Council considered the qualifications of all Commissioners and directed the Acting City Attorney to bring back an ordinance to amend Section 2.21.015 to require that all commissioners be qualified electors of the city.

 

The attached ordinance amends Section 2.21.015 of the Municipal Code to require that all Commissioners be and remain qualified electors of the city.  The ordinance makes other minor revisions by renumbering the paragraphs and revising the reference to the former section 18707.4 of the FPPC Regulations.  Section 18707.4 of the FPPC Regulations was repealed last year and its provisions were revised and moved to the current Section 18703(e)(5).

FINANCIAL IMPACT

None.
RECOMMENDATION

It is recommended that the City Council consider the adoption of the ordinance amending Section 2.21.015 of the Municipal Code to require all Commissioners to be and remain qualified electors of the city. If the City Council determines that adoption of the ordinance is appropriate, it is recommended that the City Council:

 

  • Introduce the attached ordinance amending Section 2.21.015 of the Municipal Code to require that all Commissioners be and remain qualified electors of the city.
