Acceptance of a Street Deed for an easement on a portion of property located at 11831 Trask Avenue, Garden Grove, for public street and highway purposes.  (Action Item)

OBJECTIVE

To obtain City Council approval for the acceptance of a Street Deed, which grants an easement for public street and highway on, in and over the real property in the City of Garden Grove, County of Orange, State of California, as described per the legal description shown on Exhibit “A” and delineated on plat map shown as Exhibit “B”, both of which are attached. The property  is owned by George and Beverly Paras, and is located at 11831 Trask Avenue, Garden Grove. 

BACKGROUND

At the May 17, 2018, Planning Commission meeting, Resolution No. 5921-18 was adopted, by a 5-0-2 vote with Commissioners Lazenby and Lehman absent, which approved a Lot Line Adjustment to consolidate Assessor Parcel Nos. 100-352-28 and 31 for the purpose of constructing a new single-family dwelling. 

DISCUSSION

The ultimate right-of-way of Sorrell Drive is 60 feet (60’-0”) in width between property lines, which includes a twelve foot (12’-0”) public right-of-way, as measured from the face of the curb to the subject property line.  Currently, the property with frontage along Sorrell Drive (Parcel 1) does not have the required public right-of-way.  As part of the application, the property owners were required to dedicate twelve feet (12’-0”) of public right-of-way to the City of Garden Grove, which contains an area of 718 square feet.

FINANCIAL IMPACT

There is no impact to the General Fund.
RECOMMENDATION

It is recommended that the City Council:

 

  • Approve the acceptance of the easement for public street and highway purposes for a portion of the property located at 11831 Trask Avenue, Garden Grove; and

 

  • Authorize the City Clerk to accept the Street Deed on behalf of the City.
